I do see what you are saying, but this can be applied to all areas of public life. Eg a shop is privately owned, so according to this line of thinking, if they have a community guidelines policy they too should be allowed to refuse entry without any chance of redress. Perhaps if you tap in to enter the shop, you can be considered to be accepting their terms and conditions This comes back to law. It is not being applied along the lines of what is simply understood.
